When notice is required

RPL § 226-c applies when a landlord intends to offer a renewal with a rent increase of 5% or more. The notice period is 30, 60 or 90 days depending on the tenant's occupancy or lease length (the same table as for non-renewals). If notice is late, the existing terms continue until the notice period has passed.

Good Cause: the local rent standard

For units covered by the Good Cause Eviction Law, an increase above the local rent standard is presumptively unreasonable. NYC HPD states that as of May 4, 2026 the NYC standard is 8.38% (inflation of 3.38% plus 5%, capped at 10%). If your increase is higher, the attached § 231-c notice must state your justification, and a court decides whether it is reasonable. Outside NYC, use the figure for your locality published by NY HCR.

Rent-stabilized apartments

Do not use this notice for rent-stabilized units. Their renewals use the state renewal form at the Rent Guidelines Board rates.

How to deliver it

Deliver it in a way you can prove: in person with a signed receipt, by certified mail, or by the RPAPL § 735 methods. If you mail it, allow extra days. The PDF includes a Record of Service page.

Frequently asked questions

How much notice for a rent increase in NY?

For increases of 5% or more: 30 days if the tenant has lived there under a year, 60 days for 1 to 2 years, 90 days for over 2 years (or the matching lease length), under RPL § 226-c.

How much can a NY landlord raise rent under Good Cause?

For covered units, increases above the local rent standard (NYC: 8.38% as of May 4, 2026, per NYC HPD) are presumptively unreasonable, and the landlord must justify them. Exempt units are not subject to that standard.

Is notice required for an increase under 5%?

§ 226-c's advance-notice periods apply to increases of 5% or more. Written notice is still good practice.
