Do NJ landlords have to send a late notice?
For nonpayment of rent, N.J.S.A. 2A:18-61.2 requires no notice to quit before filing. The NJ DCA eviction bulletin notes one exception: in federally subsidized housing, a 14-day notice is required before filing. This courtesy notice is not that notice.
Grace period for seniors and benefit recipients
Per the NJ DCA Truth in Renting guide, senior citizens receiving Social Security or certain pensions, and recipients of Social Security Disability, SSI or Work First New Jersey benefits, must get a five business-day grace period when rent is due on the 1st, with no late charge during it (N.J.S.A. 2A:42-6.1 to -6.3).
Late charges
Only charge a late fee if your lease provides one, and respect the grace period above.
How to send it
Hand it to the tenant, mail it, or email it. Keep a copy.
